The eDiscovery Negotiation Training: Practical Cooperative Strategies is a specialized program designed to enhance legal professionals' skills in negotiating eDiscovery processes. Organized by The Sedona Conference, a nonprofit institute dedicated to the advanced study of law and policy, this training focuses on fostering cooperation between opposing counsel to ensure efficient and cost-effective fact-finding, aligning with Rule 1 of the Federal Rules of Civil Procedure and attorneys' ethical obligations.

The program features a heavily participatory format, utilizing a litigation hypothetical and mock exercises to explore practical cooperative strategies. Participants engage in four mock Rule 26(f) conferences focusing on scope of discovery, form of production, privilege, and social media, as well as a mock Rule 16(b) case management conference. These exercises are designed to address common conflicts in the preservation, collection, production, and use of electronically stored information, with experienced faculty providing valuable critiques and feedback.

The training is limited in participant numbers to ensure a high instructor-attendee ratio and a strong participatory experience. It is "invitation only" to maintain a proper balance of participants. Those who complete the program receive a Sedona Conference Certificate of Completion, recognizing their enhanced skills in eDiscovery negotiation.
