The eDiscovery Negotiation Training: Practical Cooperative Strategies is an intensive program designed to enhance legal professionals' skills in negotiating electronic discovery matters. Organized by The Sedona Conference, a nonprofit institute dedicated to the advanced study of law and policy, this program focuses on fostering cooperation between opposing counsel to ensure efficient and cost-effective fact-finding, aligning with Rule 1 of the Federal Rules of Civil Procedure and attorneys' ethical obligations.
Key topics covered include mock Rule 26(f) conferences that address the scope of discovery, form of production, privilege, and social media, as well as a mock Rule 16(b) case management conference. Participants engage in practical exercises using litigation hypotheticals to develop strategies for resolving common conflicts in the preservation, collection, production, and use of electronically stored information.
The program offers personalized feedback from experienced faculty, including veteran trial lawyers, judges, and eDiscovery experts. It is limited to a select number of participants to maintain a high instructor-attendee ratio, ensuring a strong participatory experience. Attendees who complete the program receive a Sedona Conference Certificate of Completion.
