2022 eDiscovery Negotiation Training: Practical Cooperative Strategies

by The Sedona Conference Institute (TSCI)

The 2022 eDiscovery Negotiation Training: Practical Cooperative Strategies is an intensive program designed to enhance participants' skills in negotiating eDiscovery matters effectively. Organized by The Sedona Conference Institute (TSCI), this event focuses on fostering cooperation between opposing counsel to ensure efficient and cost-effective fact-finding, aligning with Rule 1 of the Federal Rules of Civil Procedure and attorneys' ethical obligations.

Key topics covered include the scope of discovery, preservation, form of production, privilege, and social media. The program features a heavily participatory format, utilizing a litigation hypothetical, faculty demonstrations, and mock negotiation and hearing exercises to explore practical cooperative strategies for resolving common conflicts in the handling of electronically stored information.

Participants have the opportunity to engage in three mock Rule 26(f) conferences and a mock Rule 16(b) case management conference, under the supervision of experienced faculty comprising veteran trial lawyers, eDiscovery experts, and judges. This structure provides valuable critique and personalized feedback, enhancing the learning experience.

This program is ideal for legal professionals involved in eDiscovery processes who seek to improve their negotiation skills and adopt cooperative strategies to avoid unnecessary disputes. The limited participant capacity ensures a high instructor-attendee ratio, offering a strong participatory experience and personalized attention.
