Fireside Chat #3: Arbitration Masterclass

The AALCO Hong Kong Regional Arbitration Centre (AALCO-HKRAC) hosted the third installment of its Fireside Chat series, titled "Arbitration Masterclass," on October 6, 2023. This event featured Mr. Nick Chan, MH, JP, Director of AALCO-HKRAC, and Dr. Christopher To, a barrister and chartered arbitrator renowned for his expertise in alternative dispute resolution techniques. The masterclass provided attendees with in-depth insights into the complexities of arbitration practices and procedures.

Key topics addressed during the session included compliance with escalation clauses, challenges to arbitration awards, the uniqueness of ESG-related arbitration disputes, outcome-related fee structures for arbitration, and the distinct characteristics of cryptocurrency and insolvency-related disputes. Additionally, discussions covered the effectiveness of mediation in commercial disputes, the impact of sanctions on arbitration and ADR, confidentiality in arbitration proceedings, challenges to arbitrators, the use of online dispute resolution technologies, and the potential for adjudication to replace arbitration in certain contexts.

The event was supported by esteemed organizations such as The City University of Hong Kong, the Hong Kong Bar Association, The Law Society of Hong Kong, The Federation of Hong Kong Industries, and the Young Executive Council-Federation of Hong Kong Industries. It attracted a diverse audience, including members from these organizations, lawmakers, government officials, business community leaders, and leading professionals. The masterclass was held at the historic Former French Mission Building, a venue that previously housed Hong Kong’s Court of Final Appeal, adding a rich historical context to the proceedings.

This masterclass was particularly beneficial for legal practitioners, arbitrators, mediators, and professionals involved in dispute resolution. Attendees gained valuable knowledge on contemporary arbitration issues and emerging trends, enhancing their ability to navigate complex disputes effectively.
