Optimum Proportionality Ediscovery Standard Bench-Bar Leadership Conference
The Optimum Proportionality Ediscovery Standard (OPES) Virtual Bench-Bar Leadership Conference is an online event organized by the Rabiej Litigation Law Center. This conference aims to address and critically analyze the OPES proposals, bringing together eight federal judges, ten plaintiff and defense attorneys, and other experts to provide in-depth discussions on the subject.
Key topics covered include limiting discovery to electronically stored information (ESI) that is crucial for resolving issues, promoting best practices that encourage cooperation between parties to reach a consensus on the importance of documents, implementing an enhanced validation process with random sampling of nonresponsive documents, and proposing judicial in camera examinations of documents withheld from the random sampling.
The conference offers practical insights into managing large volumes of ESI in complex cases, drawing from experiences in mass-tort multidistrict litigations (MDLs) and practices adopted by the Department of Justice Antitrust Division and the Federal Trade Commission.
