2027 eDiscovery Negotiation Training: Practical Cooperative Strategies

The Sedona Conference Institute (TSCI) is hosting the 2027 eDiscovery Negotiation Training: Practical Cooperative Strategies, a program designed to enhance participants' skills in eDiscovery negotiation. This event will be held online via Zoom on January 15, 2027, and in person at the offices of Norton Rose Fulbright in New York on February 3-4, 2027. The program aims to equip attendees with effective negotiation techniques to ensure efficient, cost-effective fact-finding and to prevent unnecessary disputes, in line with Rule 1 of the Federal Rules of Civil Procedure and the ethical obligations of attorneys as officers of the court.

The training features a highly participatory format, utilizing a litigation hypothetical that incorporates the growing influence of AI. Participants will engage in mock negotiation and hearing exercises, exploring cooperative strategies to address common conflicts in the preservation, collection, production, and use of electronically stored information. Under the guidance of experienced dialogue leaders, attendees will participate in three mock Rule 26(f) conferences and a mock Rule 16(b) case management conference, receiving valuable feedback on their performance.

This program requires mandatory advance individual and group preparation. Participants are expected to thoroughly review the litigation hypothetical and other program materials before the online component. Additionally, they will be assigned a teammate and advisor from among the program's dialogue leaders and are required to meet virtually with both prior to the in-person sessions. The Sedona Conference will seek Continuing Legal Education (CLE) accreditation for this meeting in selected jurisdictions, as dictated by attendance.
